This agreement is put in place, so you know exactly what a session with Meegan Wilmot Photography entails and to ensure that I am able to deliver on your expectations. Please read all information carefully, and if you have any questions, please reach out!

TERMS

• “Session or shoot” means your photographic session at the location where your photographs are taken

• “The client/s” means individual(s) who engage Meegan Wilmot Photography to produce photographs

COPYRIGHT

1) It is agreed that Meegan Wilmot Photography retains the copyright to all images taken at your session. It is illegal, unethical and punishable by law to scan, copy or reproduce these images for personal or professional gain. Meegan Wilmot Photography is the only entity who can crop, alter or modify any image produced at your session. 

2) Original RAW and digital files remain the property of Meegan Wilmot Photography. It is agreed that Meegan Wilmot Photography can use any image from our session for industry competitions. Any other usage of the images (eg. use on social media/general promotional material) will be confirmed with the client/s.

SESSION FEE

3) A non-refundable session fee of $150 is required to reserve your allocated shoot date, time and current fees. Should you be unable to pay your deposit at the time of booking, Meegan Wilmot Photography reserves the right to offer your time and date to other clients. The session fee is non-refundable, but is transferrable for another date / time or individual as agreed.

If you are utilising a gift voucher for your session, a $50 booking fee is required to secure your allocated shoot date, time and current fees. This booking fee is refundable against any product our package purchase. 

If you or anyone attending the session is feeling unwell, please call to reschedule. Meegan Wilmot Photography understands that sometimes, this happens. If you need to reschedule, please try to do so at least 48 hours prior to your session. In the case of not showing up for your session, you forfeit your session / booking fee.

RE-SHOOTS & ATTENDANCE

4) Re-shoots are at the discretion of Meegan Wilmot Photography and are not given for regretful personal choices such as hair and clothing, or for non-compliant children on the day of the session.

LOCATION & TRAVEL

5) Sessions will be held at an agreed upon location up to 30kms of travel from Hobart CBD. Additional kms will be charged at 85 cents per km, in line with current Australian Taxation Office (ATO) guidelines. 

THE PROCESS

6) Approximately 72 hours after your photoshoot, the best images from your session will be sent through via an online gallery. From here you will select your favourite images and choose and pay for your preferred collection and / or heirloom artwork.

7) You agree that you have received, read and understood Meegan Wilmot Photography’s price list. This price list will remain the price list for your session, even if prices increase between the booking date and your shoot. The price list does not transfer to subsequent shoots in the years to come.

8) You understand that it is my goal to create images that you simply can’t live without. Please prepare yourself to LOVE all of your images and budget accordingly.

FILE SECURITY & BACKUP

9) Between your shoot and finalisation of your order your images are fully backed up and secured as adequately as possible. Images are kept by Meegan Wilmot Photography for 12 months from the date of your photography session.

10) Once your images / prints are delivered, the handling, storage and maintenance of your portraits is your responsibility. Please make sure you download and back up your digital files as soon as you receive them and handle your prints with extreme care. Damage incurred as result of improper handling, framing or hanging is the responsibility of the client. Please be aware that light impacts everything – white frames may colour over time and black frames may fade slightly, even though they are of the highest quality.

PAYMENT / PAYMENT PLANS

11) Payment for your order is due at the time of ordering at your Design and Ordering Appointment and can be made by cash, direct deposit, credit card or payment plan.

In the unfortunate event that, full payment is not received Meegan Wilmot Photography retains the right to retain your products.

12) Your ordered products will be ready within 4-6 weeks (depending on your order), and I will contact you to arrange a convenient time for delivery / collection.

REFUNDS

13) Due to the custom nature of our products, Meegan Wilmot Photography cannot offer a refund or exchange on items once your order has been placed with suppliers. If the product is damaged or faulty, I will do my absolute best to make good or replace the faulty or damaged product.

If I'm unable to do this, a refund will be provided via the original payment method. Refunds will be provided upon the return of the damaged / faulty goods. Gift cards or vouchers are not redeemable for cash.

EDITING

14) The studio offers light skin retouching but does not offer extreme editing services such as changing clothing colours. When purchasing digital files, only Jpeg images are provided.

MONITOR CALIBRATION

15) Clients are to be made aware that there may be slight colour differences between what they view on their home computer compared to what is printed. This is due to the differences in monitor calibration. All monitors used by Meegan Wilmot Photography are fully calibrated and matched to my professional lab.

This colour variation also applies to products at customer grade labs such as Big W or Harvey Norman. In short, if you print from Big W and they don’t look the same as from a pro-lab, it is due to the poor quality of the print, not the digital file provided by Meegan Wilmot Photography.

ACTS OF GOD

16) Meegan Wilmot Photography will carry out this agreement with due and professional diligence. Elements beyond my control include faulty material, equipment failure, failed hard drives and back ups, however every effort to ensure the safety of your precious images has been taken. However, in the case of the above, liability shall be limited to a refund of any money paid under this agreement which shall be full and final satisfaction of any damage or loss suffered.
